House approves change to allow party caucuses to fill certain late vacancies

The House passed a substitute form of House Bill 458 that conforms to Senate Bill 367 to address nominee vacancies in certain judicial races that occur after party primary deadlines. Chairman Rudd said the bill corrects an unintended consequence of prior reforms that removed county authority to hold a caucus in those circumstances.
“This enables the Democrat and the Republican parties under those situations and multi county judicial districts to call a caucus or the executive body to nominate a replacement for the person who vacated the office,” Chairman Rudd said, explaining the substitution.
Representative Clemens questioned whether the change duplicates TCA section 2‑13‑204’s existing processes for withdrawal, death or nomination replacement; Rudd and other supporters said the change responds to recent statutory reforms and is necessary to ensure a mechanism exists when deadlines have passed. On procedural and fiscal questions, Representative Townes noted earlier language was removed in amendment and the fiscal impact discussion was rendered moot. The measure passed on third reading.
