Lyon County accepts fence-viewers' findings in Road 220 boundary dispute; landowners object to sharing fence costs

The Lyon County Commission voted June 20 to accept the findings of fence viewers who inspected the Childears property and adjoining landowners on the 1200 block of Road 220. County Counselor Molly Priest advised commissioners that Kansas statute K.S.A. 29-309 applies to fence-cost responsibility; following discussion the Commission approved the acceptance motion (Duft/Bartel 3-0).
Landowners who spoke at the meeting said they understood the surveyed boundaries but objected to being compelled to share fence costs. "They do not want forced ownership of the fence or to have to pay for half of the fence," the minutes record for Carolyn VanSyoc. Commissioner Chris Bartel, speaking as a cattleman, described how state law can assign liability to adjoining landowners when livestock escape; Counselor Priest reiterated that the statute, not the County Commission, governs fence-cost allocation.
