City updates stormwater enforcement in code to comply with new state law

Keith Ludwig explained that HB 507, enacted during the recent legislative session, tightened requirements for construction-site stormwater runoff controls and specified allowable enforcement procedures. Midvale staff reported the city already complied with many HB 507 provisions but needed to amend section 13.16.130.B of its Stormwater Utility chapter to align enforcement language with state law.
Council voted to suspend the rules and unanimously adopted Ordinance No. 2024-O-31 to implement the required ordinance changes. The legal department reviewed the amendment prior to consideration, and staff said the new language will clarify enforcement options available to the city.
