Traill County WRD approves Herberg Township road‑raise and ditch improvements; Moore finds no adverse downstream impacts

The Traill County Water Resource District on June 2 approved Application For Surface Drain No. 6858 filed by the Herberg Township Board of Township Supervisors for a road raise and ditch improvements along 171st Avenue SE. Moore Engineering reviewed the project and reported the work will drain approximately 390 acres and will outlet directly into Nelson Drain No. 28.
Manager Jason Lovas moved, and Manager Joel Halvorson seconded, to conclude the project will not result in adverse downstream impacts and to approve the application subject to conditions; the motion carried unanimously. The Board noted that the project’s ditch improvements will exceed the Township’s 33‑foot statutory right‑of‑way and therefore require permission from adjacent landowners and underlying owners.
Approved conditions—reflected in Surface Permit No. 6868—include a two‑year construction deadline from the District’s final approval (the period does not begin until any appeal is complete); limits on ditch dimensions (maximum bottom width of 6 feet, maximum cut of 5 feet, 3:1 field‑side slopes, and 4:1 road‑side slopes); a requirement that permittee construct and maintain erosion protection at the outlet to Nelson Drain No. 28; a prohibition on spoiling excavated material in jurisdictional wetlands; and an obligation to notify the District in advance of any proposed improvements that would increase capacity or drainage area.
Sean Fredricks, legal counsel, will prepare the Notice of Decision and provide the permit and notice to the permittee, the Department of Water Resources, and all parties of record.
