Paul Holleran moved that the commission recommend approval of the Robert & Alice Brinker Plan No. 4 with conditions; the motion passed unanimously. "Motion made by Paul Holleran and seconded by John Wright to discuss and recommend approval with the following conditions of the Robert & Alice Brinker Plan No. 4," the minutes state.
The commission's conditions require the applicant to correct a typographical Instrument Number for Lot 3 (should read "20162120004794"), show a 30-foot front building setback from Lauffer Mine Road for the remaining tract, submit a signed Non-Building Waiver form for Parcel A for Township and DEP approval, amend note language to the standard DEP non-building waiver wording, and add a revision number and date to the plan. The minutes also instruct the addition of a note acknowledging that two existing one-story wood barns encroach into the 30-foot setback and are legally nonconforming because they predate the current SALDO requirements. Representatives from Morris Knowles and recipients Jim and Karen Brinker were present; the commission forwarded its conditional approval recommendation for Board of Supervisors action.
