The motion (Moved-Seconded Flanagan-Ewing) carried.
Members of the public had earlier addressed the commission during Items from the Public with specific concerns tied to CUP #205-26. Tom Desmarais stated he believed the transfer should not have occurred because, he said, "no mining occurred in the past year and therefore the permit was inactive and void" under the county zoning ordinance; Mike Davis expressed concern about potential water contamination from selenium related to the CUP's operations. Lion Rock representatives — including Navjit Dhaliwal (Chairman), Dale Ginn (CEO) and Karly Oliver (Senior Geologist) — were present along with legal counsel Rich Williams to answer questions; the BOA conditioned the transfer on Lion Rock's written assumption of CUP terms and scheduled an annual review.
