Commissioners pressed staff to define how strictly rezoning requests should be judged against the comprehensive plan's future land use map and where discretion should apply. One commissioner advised that courts commonly consider changed conditions when evaluating rezonings: "That is when you would definitely wanna keep as, a legal requirement in Colorado," the commissioner said, arguing that consistency with the comprehensive plan can provide a legal basis for approval.
Staff (Donna) confirmed the comprehensive plan includes both a future land use map and narrative goals; she said the map appears on page 63 and narrative references begin on page 57 of the 2021 update. Commissioners asked staff to provide example scenarios (for instance, an adjacent rezoning in process) so commissioners will know what evidence and staff brief content they should expect when assessing whether conditions have changed.
