Middlesex rescinds April noise ordinance and forms review committee

County Attorney Heather Lewis explained that the prior 2004 noise ordinance had been rendered unenforceable by Virginia Supreme Court case law and that the April 7, 2026 ordinance prompted substantial public input leading staff to prepare a rescission ordinance. Lewis told the Board that rescinding the April 7 ordinance would leave the County without a noise ordinance in effect and would not reinstate the 2004 rule. The Board adopted the rescission ordinance by unanimous roll-call vote after a motion by Supervisor Bill Harris and second by Supervisor Williams.
Following the vote Lewis and staff reiterated that the Board had already directed creation of a Noise Ordinance Review Committee to solicit broader public input; formal appointments were deferred to the July meeting. The Board emphasized the county will continue collecting names of interested citizens and that staff should seek representation from stakeholders supporting and opposing various provisions.
