Board approves art gallery and wine bar at 804 Lake Avenue with conditions

The Historic Resources Preservation Board voted to approve HRPB project 26-00500002, allowing an art gallery and wine bar with live entertainment at 804 Lake Avenue with staff-recommended conditions.
Anne Hamilton, the staff presenter, told the board the property is a contributing resource in the Old Town Historic District and that the application meets findings in the comprehensive plan and land-development regulations but carries conditions to address neighborhood impacts. "We are recommending approval with conditions," Hamilton said as she listed recommended mitigations and administrative items.
Applicant Kelly Absher, who said she and her husband Guillermo are the business owners, told the board they took over the venue last July and only recently learned a permit was required for live entertainment after staff notified them. "We don't sell bottles of wine for people to purchase there and take home. It's not something we've even considered at this point. It's just for on-site," Kelly Absher said in response to board questions about raffles or off-premise sales.
Board members asked whether fundraising events or raffles that might result in bottles leaving the premises would be restricted; staff clarified that the alcohol-distance waiver and permit as approved allow nonpackage sales for on-site consumption only. A board member moved to approve the project with staff recommendations; the motion was seconded and passed by voice vote.
The approval included conditions from planning and zoning and historic preservation staff; the applicant confirmed willingness to meet the listed conditions and to work with staff on any follow-up items. The board did not modify the approved conditions beyond those recommended by staff.
