Board counsel gave trustees a procedural update on litigation the Elite charter school has filed against the City of Vallejo. Counsel said the complaint includes six causes of action that the parties have organized into writ claims and non-writ claims; the writ claims will be resolved through briefing and a judge's hearing, while the non-writ claims will proceed through discovery and potentially to trial.
Counsel said, "There are 6 causes of action" and listed categories including a writ under the Code of Civil Procedure, an alleged municipal-code violation, a Brown Act claim and a regulatory-takings claim. Counsel added the parties have stipulated to a briefing schedule for writ claims and that a joint settlement conference is set for Jan. 31; there is no hearing or trial date yet. Trustees were advised to expect discovery to take substantial time if the non-writ claims proceed.
Trustees asked whether there are immediate facilities implications; counsel said there is no decision yet on the permit and that the board could be updated after the Jan. 31 settlement conference.
