Becca from the county zoning office presented the preliminary plat for Jackson Estates, a proposed 15‑lot major subdivision in Section 12, Township 86 North, Range 4 East, zoned A‑1 agriculture. She said the zoning commission held a public hearing and recommended approval subject to conditions covering roadway grade, stormwater/drainage, private road design, utilities and clarified fencing/covenant provisions. "The recommendation before you is approval of the Jackson Estate's preliminary plat by resolution subject to the conditions attached as Exhibit A," Becca said.
The most contested issue was the private roadway gradient. The county subdivision ordinance establishes a maximum roadway gradient of 7%; the county engineer recommended a maximum of 12% while the zoning commission recommended accepting the 18% grade shown in the submitted plan. Eric Tutt of WHKS told the board that the 12% figure comes from guidance for public local streets but argued a private drive differs from a public through street and pointed to local precedent of steeper grades. The board debated safety, snow removal and drainage, and emphasized that a private road would not be county maintained. Supervisors agreed the conditions should address fencing, drainage and bonding, and the board voted to approve the preliminary plat and the requested grade modification as part of Resolution 1178‑04‑28‑2026.
Under the approved motion the applicant has 12 months to submit a final plat and must complete or secure required improvements by surety before final plat approval.
