Board backs LDR updates creating new ‘manufacturing processing with apparatus’ use for Industrial Park Of Commerce

The Historic Resource Preservation Board voted Dec. 10 to recommend the City Commission adopt ordinance 2025-30, a multi-section update to the city’s Land Development Regulations that clarifies definitions, modernizes industrial-use standards and creates a new use category described in the record as “manufacturing processing with apparatus.” Scott Rodriguez, planning staff, summarized the changes and said the amendments strengthen compliance requirements for health, safety and environmental standards in the Industrial Park Of Commerce (IPOC) zoning district.
"Some of the key changes are new and updated definitions, adds definitions for apparatus, manufacturing processing facility facilities with apparatus and use area, use table revision, creates a new use category for manufacturing processing with apparatus," Rodriguez said in his presentation.
A board member raised objections about the potential breadth of the new 'apparatus' category and whether it could apply in historic areas or result in unacceptable uses near parks, the ocean and the golf course. The member said the scope felt broad and asked why such a definition would be relevant to historic districts. Rodriguez responded that the proposals apply only to the Industrial Park Of Commerce zoning district and are not intended to change standards in historic areas: "This only applies to the IPAC District."
A committee member moved to recommend the City Commission adopt the proposed LDR text amendments included in ordinance 2025-30; the motion was seconded and the board voted in favor to recommend the ordinance. The recommendation will be forwarded to the City Commission for its review.
The ordinance package includes changes to parking rules (oversized vehicle parking dimensions and use-area-based parking), hours-of-operation standards with waiver options, performance standards for apparatus-based facilities, and coordination requirements with school traffic patterns.
