Zoning appeal for Iron Mine Road continued to Aug. 25 so counsel can appear

The North Smithfield zoning board on July 28 voted to continue an appeal involving Iron Mine Road to a date certain of Aug. 25 so legal counsel can represent the zoning official and the appellant can present the case.

Town legal counsel told the board the appeal had been filed timely by the appellant and that the zoning official will have counsel appointed by the town council before the hearing. Counsel said the matter should be continued so the parties can be represented and prepare: "The whole thing's just getting continued to a new date, and then there will be the zoning board of appeals here with counsel beside mister Cody representing him and mister Zengarry putting on his case," the counsel said. The board then took a motion to set Aug. 25 as the date certain for the appeal (recorded as ZBA26-001) and approved it by voice vote.

The chair and board members agreed there was no reason to enter additional evidence into the record at this time because the parties will submit any further documentation before the rescheduled hearing. Legal counsel advised the board to defer merits until the hearing with counsel present. The board did not take any substantive evidence or rulings on the merits at the July 28 session; the action was strictly a scheduling continuance.
