Member Patrick Hanlon (author of the draft decision) explained that an earlier special permit issued in 2024 remains technically in effect but is unused; after consulting counsel he revised the draft to explain the situation and removed a prior condition that would have attempted to force abandonment of the old permit. As Hanlon explained, "there's nothing there's nothing wrong legally about having 2 special permits that deal with the same subject matter," and the board accepted revised paragraph wording and eliminated the conflicting condition. The decision was approved and will be filed following the board’s standard procedures.
