A resident identified by the chair as "Nicholas" used the public-comment period to raise allegations about a pending lawsuit and the village's handling of legal bills. He told trustees he believed depositions in the matter would soon begin and accused the village's counsel of making false representations to the court about the source of legal-bill payments.
"So is it insurance or is it not insurance?" Nicholas asked, challenging the board's prior statements and the lawyer's court filing. He said the municipality "did not get favorable rulings" in recent court proceedings, that depositions of "mister O'Keefe and depositions of mister Duffy" will begin, and he demanded that the village refund what he called "the illegal money that you took from us." His remarks preceded the trustees' motion to enter executive session on pending litigation.
Trustees did not respond to the specific refund demand on the record and moved into a closed executive session immediately afterward to discuss attorney-client communications and pending litigation.
