Commission approves settlement returning Hangar J to Newton City-County Airport
Summary

The Harvey County Board of Commissioners on May 6 approved a Settlement Agreement and Consent Judgment resolving litigation over Weatherly Aircraft’s default of the Hangar J lease at the Newton City-County Airport.
City Attorney Chris Towle and former County Counselor Greg Nye presented the agreement, which acknowledges termination of the lease, returns possession of Hangar J to the airport and provides for recovery of some unpaid rent, flooring costs and utilities. The board approved the settlement after a clerical correction to an effective date in section 3(g) (changed to June 15, 2025). The board’s vote was unanimous.
The meeting packet included a multi-page settlement package and a factual summary that documented a timeline of missed rent, notices and court filings dating back to 2018. The packet noted that the airport had already secured the hangar and that the district court previously granted possession to the airport while leaving certain back-rent claims for trial; the settlement resolves the remaining litigation issues described in the petition.
The county and the airport will follow the settlement’s implementation steps as laid out in the consent judgment and related documents. The county’s materials also list earlier court dates and motions, including a March 27 court ruling granting the airport possession of Hangar J and awarding flooring and utility costs while leaving unpaid rent to trial.
