Council approved measures authorizing the acquisition of rights, easements and other interests necessary to complete two major drainage projects and authorized filing declarations of taking under section 302 of the eminent-domain code if required.
The Lindy Creek stormwater improvements measure instructs staff to acquire necessary permanent and temporary easements and permits declaring a taking if negotiations do not secure rights voluntarily. The Kaiser Valley flood protection resolution includes similar authorizations to obtain property interests needed to complete flood mitigation work. Both items were recommended for final passage by the public-works committee and were adopted on roll call.
Council members said the projects are necessary to advance drainage and flood-protection work; the chair declared both items legally and lawfully adopted. The measures authorize staff to pursue negotiated easements and, if necessary, to proceed with eminent-domain steps consistent with statutory requirements.
