Story County moves to rescind Ordinance No. 311 after federal ruling; second reading set

Leanne Harter, Planning and Development Director, told the Board that staff is proposing Ordinance No. 329 to rescind Ordinance No. 311 after a recent federal court ruling made enforcement of the older ordinance unenforceable. The Planning and Zoning Commission recommended approval of the text amendment and staff presented standards of approval which the project satisfied.
Murken opened the public hearing and, hearing no comment, closed it. The Board approved First Consideration of Ordinance No. 329 and set Second Consideration for March 10, 2026 by unanimous roll-call vote.
Harter said rescinding Ordinance No. 311 will revert the county to prior definitions and regulatory language where applicable; staff will return with the ordinance on March 10 for final action.
