Attorney Anne Collins, of Lozano Smith, told the board the district must follow both Education Code and the Surplus Land Act before disposing of school property. Collins said the process includes convening a 7‑11 advisory committee, making statutorily required offers to various public entities and, if necessary, adopting a resolution of intent to sell that must pass by a 0.667 vote. Financial adviser Kathy Domenico described committee findings on three candidate sites and recommended pursuing surplus designation for Atwood so staff can investigate options to “maximize the value of the property and minimize the resources we're spending on that.”
“We're at the beginning of the process,” Domenico said. “Tonight, what we're asking you to do is to initiate the process.” The board adopted resolution 24‑25‑110, declaring Atwood exempt surplus land and directing staff to begin the required offers and further evaluation. Trustees and staff emphasized that declaring a parcel surplus does not commit the district to sell it, and that proceeds from any sale are restricted by law to capital improvements.
Next steps: staff will pursue the statutory notice and offer requirements, explore entitlements or partnership opportunities, and return with options and any recommended waiver requests (such as a State Board of Education waiver) before any final disposition. The resolution passed on a roll‑call vote with no dissent.
