The council heard an appeal from applicant Jeff Skelton seeking a commercial‑vehicle permit that would have put him ahead of other applicants on the city's wait list. City legal counsel Scott Campbell advised the council: "It is our legal view that the municipal code does not allow the city council to grant this permit and allow this person to jump over or leapfrog other people on the wait list," and recommended denying the appeal and refunding the appeal fee.
Staff reported Mr. Skelton had one 30‑day temporary permit in January 2025 and that there are more than 70 businesses ahead of him on the wait list. Council members discussed fairness of the wait list and the lack of detailed operational information from the applicant about his vehicle/trailer needs. A motion to uphold the hearing officer's decision and refund the appeal fee passed on a roll call that produced four ayes and one abstention; the council therefore denied the requested permit and directed return of the appeal fee.
