City Attorney Joanna summarized a settlement reached that day between developer QMC (referred to as Quartera/QMC in the staff report) and neighboring property owner David Grampa related to a mixed-use permit appeal. Joanna said two other appeals had been dismissed and that Grampa's appeal remained active, but QMC and Grampa signed a settlement agreement today. She said city staff and the city attorney reviewed the agreement and that none of the city's obligations under the settlement were monetary.
The council went into a 10-minute executive session under RCW 42.31.110(1)(i) to discuss litigation strategy with counsel and returned to the public meeting. A motion to approve Resolution 1883 and authorize the mayor to enter into the settlement agreement passed on a voice vote. Joanna told council the agreement keeps project actions within the scope of the original permits and that city approval is now requested to finalize the settlement.
No detailed settlement terms were read into the record at the meeting beyond the attorney's summary that the parties had reached agreement and that the city would not be required to make monetary payments.
