Staff explained the proposed cul‑de‑sac currently demonstrates a partial right‑of‑way; the applicant and a neighboring landowner have discussed an exchange that would allow the full right‑of‑way to be dedicated prior to final plat. Ken Berg (city engineering) and applicant representative Ross Welch described grading and sidewalk negotiations with the adjoining owner; Welch said the parties have a verbal agreement and are working to document it. Staff recommended the boundary line adjustment be completed before final plat approval and that the plat include notes dedicating the public street and requiring FEMA approvals for any building footprints in flood zone AE.
Commissioner John McKay moved to approve the preliminary plat subject to the boundary adjustment reflecting the right‑of‑way shown on packet page 92, trail location determination, plat notes dedicating the street and the FEMA floodfootprint note; Jeff Davis seconded. After an amended clarification on right‑of‑way language, the motion passed unanimously. Staff will require a recorded boundary adjustment consistent with the approved exhibit before final plat recordation.
