The Angola plan commission approved a variance (case 2026BZA07001) allowing six-foot vinyl fences in front yards for certain Eastland Crossing lots that face State Road 827.
Staff summarized the request and recommended approval. Planning staff noted the request affects 17 lots in section 1 and four proposed lots in section 2 and that legal notice was sent to 85 property owners and published July 17. "In conclusion, the staff does recommend approval for the requested variance," staff said. Staff also emphasized that each homeowner must still apply for an individual fence permit and that fencing must remain outside the utility easement.
Applicant Leroy Sturi, representing Stury Builders and serving as the association president, told the commission the change follows updates to association covenants and described the practical concern driving the request: "the hardship is, you know, even just for safety of children in their backyard, and being able to, you know, in their backyard and enjoy it," he said, explaining that some homeowners bought lots expecting to be able to enclose yards for safety and privacy.
Commissioners discussed setbacks and easement lines and agreed fences could be placed up to (but not inside) the 20-foot utility easement on the east side of the evergreen screening. The commission found approval "will not be injurious to the public health, safety, morals, and general welfare" and that denial would result in practical difficulties for use of the property.
Susan Ralston moved to approve the variance as applied for with the condition that each property owner must obtain a permit before constructing a fence; David Roe seconded. The motion passed and was recorded as approved.
