Tuloso-Midway ISD board authorizes $2 million court deposit, seeks possession in condemnation case

The Tuloso-Midway Independent School District Board of Trustees voted unanimously at a special meeting Jan. 29 to authorize the district to deposit a $2,000,000 Special Commissioners' Award into the registry of the court and to pursue possession of property subject to the district's condemnation proceeding against Braham Ranches, LLC.
"I move that the Board of Trustees adopt the resolution as presented, authorizing the Superintendent or the Superintendent's designee, to deposit into the registry of the Court the full amount of the Special Commissioners' Award in the amount of Two Million Dollars ($2,000,000), together with any required court costs, registry fees, or other amounts required by law, from the District's legally available funds, including authorized bond proceeds," Trustee Kim Boone said when she moved the resolution. The motion was seconded by Trustee Rick Chapa. The board voted 5–0 in favor; Trustee Paul Arriaga was recorded as absent.
The resolution, which was read aloud by Board President Leo Gonzalez, authorizes the district to deposit the award and any required court costs and fees and, upon deposit, to take possession of the property at issue in the condemnation proceeding. The action also authorizes the superintendent or a designee to "take all actions necessary to secure, maintain and protect the property, and to perform site preparation, and pre-construction and construction-related activities" in support of the district's planned public improvements, pending final determination of compensation.
The board considered the matter in closed session under Texas Government Code Section 551.071 for consultation with legal counsel about pending litigation in Cause No. 2025CCV-61362-4, styled Tuloso-Midway vs. Braham Ranches, LLC. The resolution directs district officials and legal counsel to deposit the award into the court registry and pursue an Order of Possession as needed to proceed with planned improvements.
After the vote the board announced upcoming meetings — a special called meeting set for Feb. 9, 2026 and a regular meeting on Feb. 16, 2026 — and adjourned at 6:50 p.m.
