The commission held a public meeting on a notice of violation for 72 Grassy Hill Road after staff said an application to remedy prior unpermitted seawall work had been filed. Attorney Rand Sapoel represented the applicants and described the property's history and the construction that was completed without permits. Neighbors and easement holders raised concerns that the new cement seawall replaced a previously rocky shoreline, questioned notice procedures, and said they want to preserve access under existing easement terms.
Staff reminded the commission that state statute requires the commission not to act on an application the same night it was filed, so the matter will be continued to the next meeting to allow neighbors time to request a hearing. Counsel said the applicants filed an application the day before and characterized the current submission as an effort to remedy the violation; staff reiterated that the commission must consider it under wetlands criteria and is not a venue for resolving private easement ownership disputes.
