Julie Powell, chief executive officer of McAlester Regional Health Center, addressed the council to explain how the hospital authority functions under an irrevocable public trust created under Oklahoma law. She said trustees were given authority "to manage the trust, its assets, its operations, independently under the terms of the trust agreement" and that the trust exists to serve the people of McAlester for the benefit of the city.
Powell described the trust estate as governed by a 70‑year lease that runs to 12/18/2043 and includes an option to renew if notice is given six months before expiration. She said the trustees operate independently and "must conduct business publicly and transparently," while the hospital administrator is responsible for day‑to‑day operations and reports to the trustees. Powell cautioned that voluntary termination of the trust is constrained by outstanding debt: bonds or loans must be settled or creditors must agree in writing before dissolution is possible.
