Petitioners George H. and Terry L. Rinehart and David G. and Patricia A. Bennett filed a petition dated Aug. 30, 2024 asking the Town of Lumberport to abandon a portion of an alley that separates their parcels in the Harter Addition. The petition says the alley "has not been and is not currently used as a throughway nor has it ever, in the property owners 50+ year family ownership, been maintained as a road." The petition was drafted with the assistance of real estate agent Jennifer Newman.
The petition package included a GIS exhibit labeling Rinehart parcels "R," Bennett parcels "B," and a Gillespie parcel "G" which touches the alley but is described as not adversely affected. The petition lists multiple lot legal descriptions in the Harter Addition and supplies E-911 addresses and owner mailing addresses. The petition concludes with the request: "Please consider our request, as abandoning this unused alley will assist these citizens of Lumberport in fulfilling future endeavors." The scanned petition pages in the minutes include signature and notary blocks dated 9/5/24; some transcribed notary text in the minutes contains inconsistent spellings and dates.
