The Neodesha Board of Commissioners on May 13 adopted Resolution No. 26-08, finding that the garage located at 603 Walnut Street violates the City of Neodesha Environmental Code (Article 3, Section 26-43) and is unsafe and a blighting influence.
The resolution gives the property owner 30 days from the date of publication to commence abatement or cleanup. If the owner fails to diligently prosecute the work until completion, the governing body will have the premises repaired or abated and assess the costs as a special assessment against the lot.
The public hearing on the property opened at the meeting and property owner Angela Millis appeared for the hearing and discussion before it was closed. Administrator Jones presented the enforcement record and staff recommendations before the resolution was adopted on a motion by Commissioner Truelove, seconded by Commissioner Banzet.
The resolution directs the City Clerk to publish the resolution once in the official newspaper and to mail a copy to owners, agents, lienholders and occupants as provided by law. The resolution text includes the legal description of the property and the authority to assess costs if the city completes the abatement.
