Staff warns of sweeping state zoning changes; Barnstable staff preparing guidance

Planning director Jim Comfort told the committee that a series of state-level changes to Chapter 40A and related statutes are already in motion and are changing variance standards, notice requirements and other zoning procedures. He said one change lowers the variance scrutiny language and that the legislature amended 40A to allow notice by email under section 11, but noted Barnstable lacks a certified email list for all residents.

Comfort said staff are preparing a comprehensive guide for how the state amendments could affect Barnstable and plan to present it first to the Zoning Board of Appeals and the planning board before returning to the committee. He also flagged an October timetable for some clean-energy rule changes and said staff are monitoring additional economic bond-bill provisions and federal guidance that could affect local zoning.
