Committee members raised the possibility of using a memorandum of understanding (MOU) or statute to require regular reporting from the Agency of Digital Services (ADS) to legislative oversight. Members noted limits on current resources in the Legislature and the Joint Fiscal Office (JFO), and asked for advice on which mechanism would be more appropriate.
Tim Ash said an MOU is an acceptable practice, particularly where personal or confidential data require clear handling, but he emphasized the more fundamental issue is legislative resources for sustained deep-dive oversight. "An MOU is all fine, but if you don't have the resources to get the deep dive on more projects... then I think MOU is not quite the most important question to resolve," Ash said, urging the committee to consider dedicating more staff capacity to IT oversight.
