County will remove Ordinance 39 on food and beverage licensing after local health board dissolves; enforcement referred to state

Alex Schultz, Planning & Zoning Technician, reported that Brown-Nicollet Health has dissolved and that Cottonwood County no longer has local jurisdiction over licensing and inspection of food and beverage establishments. As a result, Ordinance 39 (Regulation of Licensing and Inspection of Food and Beverage Establishments) will be removed from the county code and referrals for enforcement will be directed to the Minnesota Department of Health.
The change transfers primary enforcement responsibility for these establishments to the state agency and requires county staff to redirect enforcement inquiries and referrals. The minutes record the notification and the board's acceptance of the recommended change; the ordinance removal and referrals are to be implemented administratively.
