Trustees and the village attorney discussed technical and legal measures to protect the village if the project is built in stages. Attorney Shaw outlined a likely approach: vacating the existing plat, consolidating lots and approving a Planned Unit Development (PUDE) that would allow multiple structures on a single lot while including covenants to require maintenance, snow removal and public‑improvement performance bonds. Shaw said such public improvements could be secured with performance bonds and covenants could allow the village to perform maintenance and add costs to the property tax bill if an owner fails to do so.
Board members raised questions about road access for residents and emergency services, whether the project would be age‑restricted assisted living (the transcript references 65+ in the developer’s concept and a discussion noting federal guidance that can set lower age thresholds), and what tax classification and commercial services might accompany the project. Trustee Walter and other trustees asked the developer to return with more detail at the July meeting so the board can consider specific permit, plat and bond conditions.
