Legislature approves $315,000 to cover special prosecutor costs in People v. Edward V. Holley

Andrea Concannon, Deputy Commissioner of Finance, told the committee the county must comply with a court order from the Hon. James McCarty to fund special-district-attorney costs in People v. Edward V. Holley and moved to appropriate $315,000 from contingency to cover those expenses.
Concannon said the county previously allocated $1 million in 2024 for a special prosecutor and that nearly $600,000 of that amount was returned to fund balance. Christopher P. Borek, Chief Assistant District Attorney, explained the State Police arrested the suspect without notifying the District Attorney’s office, necessitating appointment of special prosecutors; the Administrative Judge for the 9th Judicial District appointed retired Westchester County ADAs to handle the case and county law requires the county to pay those expenses. Borek added higher costs followed a mistrial and the need for expert witnesses and out-of-state witness travel; Concannon said the funds are already in contingency and reallocation does not require new tax revenue.
