The Nevada State Board of Pharmacy on Oct. 16 concluded a disciplinary hearing for Bernard Brooks and imposed a stayed revocation and five‑year probation with conditions. The Board found Mr. Brooks guilty on several counts of the Accusation while finding him not guilty on Counts One and Two.
The Board admitted into the record a memorandum of attorney fees and costs totaling $6,656.06 and ordered a $5,000 fine for the violations. The Board ordered that Certificate of Registration No. 20571 be revoked, but that the revocation be stayed and the registration placed on probation for five years. The Board required Mr. Brooks to participate in a PRN (or equivalent) program during probation and to submit quarterly reports to Board staff. The Board also restricted Mr. Brooks from serving as a managing pharmacist at any pharmacy other than his current employer (Option Care) during probation unless he petitions the Board for approval.
Motions on factual findings and individual counts showed division among members on some counts. For example, votes on Count Three and Count Four were recorded with five ayes and one nay on guilty findings; other counts returned differing yea/nay splits. The Board ultimately passed the motion imposing sanctions.
The Board recorded that the $5,000 fine is due and payable by Oct. 16, 2026. The transcript shows the Board admitted exhibits, heard multiple witnesses and continued the hearing overnight before resuming and issuing findings and sanctions the next day.
