Nevada Board of Pharmacy adopts staffing and dispensing rule amendments

At a workshop presented by Executive Secretary David Wuest and Deputy Secretary Yenh Long, the Board considered public comment from pharmacy-industry representatives including the Nevada Pharmacy Alliance, the Retail Association of Nevada, Albertson’s Companies, CVS Pharmacy and Walgreens. Adam Porath moved to adopt the proposed regulation with targeted edits to the staffing language and thresholds; Richard Tomasso seconded and the motion passed unanimously.
The motion amended Section 2 to read in part: "A pharmacy may be staffed with one pharmacist. A pharmacy must be staffed 75% of the time of each day the pharmacy is opened to the public…" and added a clause referring specifically to pharmacies "that the pharmacy fills greater than 250 prescriptions…". Board minutes record that the motion also changed language in Section 3, Subsection 4A from "shall resolve" to "shall address."
Board members and staff said the amendments are intended to create clearer statewide expectations for supervision and timing of dispensing; industry representatives had urged tweaks to operational definitions during public comment. The regulation was adopted with the amendments as moved and passed unanimously. The transcript does not specify an effective date for the regulation.
