Commission recommends Thorpe Way right-of-way vacation to county commissioners with conditions

The Elko County Planning Commission recommended approval to the Board of County Commissioners of a right-of-way vacation request from Warren and Diana Russell to remove an older mapped right of way and replace it with a new 30-foot-wide public access, utility and drainage easement that follows the existing road alignment. Staff recommended the easement rather than dedication of right of way to avoid creating nonconforming parcels, and conditioned the recommendation on compliance with state statute NRS 278.480 and the creation of the new easement.
Bob Tebow of High Desert Engineering said the existing gravel/drive road is built in locations that do not match the mapped right of way and that vacating and rededicating the entire easement is "the cleanest" way to resolve the mismatch. Warren and Diana Russell told the commission they will continue to maintain and improve the road and appreciated the commission's consideration. The commission voted to forward the application to the county commissioners with staff findings and conditions.
