Council annexes Grant B. Kohler Trust parcel with 85-foot River Road setback and adopts annexation agreement

The Council voted to annex a 2.23-acre parcel owned by the Grant B. Kohler Trust at 970 North River Road and adopted Ordinance 2026-19 approving the annexation along with Resolution 2026-17 implementing the annexation agreement. Staff said the annexation adds one new single-family lot while preserving the property's rural character and that required water rights must be dedicated before subdivision plat recording.

During the public hearing, Paul Berg (engineer for the applicant) asked that the originally proposed 100-foot setback be reduced because it limited the usable building area. The Council discussed possible fixed distances and agreed on an 85-foot setback as reflected in the motion. The ordinance includes conditions: dedication of required water rights before plat recording, use of an existing driveway for access (no new River Road driveway), a park annexation fee of $1,313.71, and compliance with Midway Sanitation District and Midway Irrigation Company requirements. Council Member Lisa Orme recused herself on the annexation due to a family relationship with the property owners. The ordinance and the annexation-agreement resolution were approved by the remaining council members.
