The Board of Zoning Appeals approved a variance for 1401 N. Keowee St. to allow removable reflective window film that staff said is necessary to reconcile state security regulations for cannabis dispensaries with Dayton’s zoning rules.
Planning staff (Jeff Green) described the same code conflict cited in an earlier case: the city’s standard for the applicable commercial zoning requires significant display-window area while state DCC security rules require window film. Staff recommended approval with a requirement that the film be removed if the dispensary closes: “Should the marijuana dispensary close, the window film be removed.”
Attorney Greg Gorospe represented the applicant and stated that his remarks from the previous case applied here as well. The board described the application as clean and moved to approve it with the staff condition. The motion was made by Ms. Jacquelyne Patterson and seconded by Mr. Tim Bement. Vote: Tim Bement Yes; Joe Shaw Excused; Diana Graham Yes; Jacquelyne Patterson Yes; Patrick Martin Yes; Joe Craig Yes; Chris Lewis Excused.
No separate operational limits beyond the removal condition were imposed.
