Commission orders adjudicatory review after reports a VIP host contacted an excluded patron

The Massachusetts Gaming Commission directed staff to pursue a full adjudicatory hearing after the Investigations and Audit Bureau briefed a case in which a Penn Sports Interactive (PSI) VIP host contacted an individual enrolled in a voluntary cool-off period multiple times.
Nathaniel Kennedy of the IAB said the contacts occurred via text messages on dates including Sept. 23, 2025; Oct. 7 and Oct. 31, 2025; March 16, 2026; and May 29, 2026, and that the IAB alleges violations of the relevant 205 CMR provisions. "This event involves a PSI VIP host contacting 1 individual enrolled in the voluntary cool off period," Kennedy said.
Commissioners, led by Chair Jordan Maynard and Commissioner Broder, said they wanted a full commission review and asked the IAB to appear as a party (the prosecuting party) at an adjudicatory hearing so the commission could act as factfinder. Commissioner Skinner argued the case "could benefit from having a full blown adjudicatory hearing" to gain insight into VIP-program operations and remedial options. The commission did not resolve penalties at the meeting; instead it directed the IAB to prepare the case for adjudication and schedule proceedings.
