A representative for Rio Larma LLC asked the magistrate to reduce an accrued fine of $96,400 to $1,000. The assistant county attorney explained the legal standard under county code and had the county’s hard costs read into the record as $6,493.98.
"Respondent has requested that the accrued fine of $96,400 be reduced to $1,000," the county attorney said. The magistrate said his recommendation authority is limited to reducing fines no lower than the county’s hard costs and entered a recommended order to the Board of County Commissioners to reduce the fine to $6,493.98. The magistrate advised the representative to attend the BOCC meeting on Sept. 12, when the commissioners will take final action.
