Lyon County Accepts Fence-Viewing Order, Directs Landowner Notices Under Resolution 62-96

County Counselor Molly Priest provided commissioners with a draft order prepared after a fence viewing on Aug. 6, 2025. The order states the current fence exceeds Lyon County fence requirements under Lyon County Resolution 62-96, applies the traditional right-hand rule and directs that each landowner contribute equally toward construction of a legally sufficient fence. Commissioner Chris Bartel said the order matched his understanding of the law; the commission accepted the order 3-0.
Staff will send copies of the Fence Viewing Minutes, the Order and a map to affected landowners. Ryan Benton, a landowner, voiced concerns about the determination during the discussion; the final action in the minutes shows the commission accepted the Order despite his concerns.
