Property owner Crystal Dawn Yoder asked the Board of Zoning Appeals to approve a lot split for 111 and 113 West North Street so each unit of a proposed duplex can sit on its own parcel.
Planning staff (James) told the board the property sits at the intersection of West North and Opera House Way and lies within the Old Town Mixed Use Commercial District and the Historic Overlay District. Staff said the variances requested are for lot size and lot width to allow a duplex where the zoning ordinance requires each dwelling unit be on a separate lot. Staff summarized applicable review criteria and recommended approval: "Recommendation is for approval." The staff report listed dimensional details: the permitted lot depth was stated as 28.8 feet for the proposed lot (the applicant requested 72 feet), the permitted depth for the modified existing lot was listed as 25.3 feet (the applicant again requested 72 feet), and minimum lot width required is 20 feet while the new parcel would be 19.21 feet and the existing lot 16.89 feet.
Yoder described the property's family history and the practical reason for the split: the house was inherited and at one point the property was deeded to seven people, complicating future sales. She said splitting the parcel would let her grandchildren inherit separate halves rather than co-owning a single lot. "And, I don't want my grandchildren to have to go through that same thing," she told the board.
David L. Leonard, speaking for the applicant, described the demolished duplex and the new build. He said the height of the rebuilt structure "is pretty much the same" as the prior building and that the left and right units are similar in length apart from an older addition that had no foundation. Board members asked about setbacks and the area behind the building; staff and the applicant confirmed the rear area is for parking only and that the new structure will sit to the park edge.
The board did not take a final vote on the variance at the public hearing. After public testimony and questions, the board moved to deliberate the application; the motion to go into deliberation passed (the chair recorded the board as in deliberation at 07:10). The application will return to the board when deliberations conclude with a formal decision or vote.
