The Hampstead Board of Zoning Appeals on July 27 approved a variance allowing homeowners Brandon and Christine Kalmowitz to install a 10-by-16-foot above-ground pool at 4213 Mead Drive that would extend 2 feet 6 inches into the required side-yard setback. Christine Kamowitz told the board, "I'm the property owner for 4213 Mead Drive, and I'm looking for a variance so that we can install an above ground pool on our property," and said the right side of the house is the only practical location given existing easements and a basement exit on the opposite side.
The zoning administrator explained the code requires a 10-foot setback for pools and related structures and that the applicants requested relief to reduce the side-yard setback from 10 feet to 7 feet 6 inches. Neighbor Edward Prince spoke in support, saying of the proposed installation, "I have no problem with pool," and noting the yard is already fenced and screened by tall arborvitae. During deliberations board members cited the property's constraints and the town code criteria supporting a variance; a motion to approve the variance was made, seconded, and carried with affirmative votes recorded. The meeting record includes the application materials, HOA letter, and architectural drawings filed with the case.
