The Garland Plan Commission on April 27 unanimously approved a special use permit (Z26‑ten) allowing a drive‑through restaurant at 480 West Interstate Highway 30 and approved an associated concept plan for a 15‑year term.
Kalyan, a city planner presenting the case, said the 0.67‑acre site contains a 2,286‑square‑foot commercial building that historically operated as drive‑through restaurants and is currently vacant. "The applicant is requesting for a 15 year SUP," Kalyan told commissioners, and staff recommended approval with conditions including a loading space, reorientation of the refuse container, and landscaping improvements that were triggered by those site changes.
The commission heard questions from commissioners on parking and landscaping. Staff said the Garland Development Code (GDC) currently requires 23 parking spaces for the proposed use; the site has 18 existing spaces. Staff explained that an alternative compliance process — typically a licensed transportation engineer's parking study or a recorded parking agreement — can be pursued after SUP approval during the site‑permit review. "So it can be a study or an agreement," Kalyan said, describing the administrative process for alternate compliance.
Commissioner Jenkins asked that the applicant use native ornamentals rather than crepe myrtles to reduce water use; the applicant's representative agreed. "We'll add that into our plants," the applicant's representative, Jose Murga, said. Murga introduced himself as representing DIG Engineers and said the applicant owner is Dan Nguyen.
The applicant, through Murga, said the project team will pursue the required permit work and compliance steps. After public‑hearing discussion, a commissioner moved to close the hearing and approve staff's recommendation for Z26‑ten with a 15‑year SUP; the motion was seconded and passed unanimously. The chair closed by wishing the applicant luck with the restaurant.
