The Sweetwater County Board of County Commissioners approved a joint order denying the petition to form the Lincoln Star Improvement and Service District after the petitioners formally withdrew their request.
Chair said the board received a written withdrawal and presented Resolution 25‑11‑CC‑01, a joint order denying the district formation. Chief Deputy County Attorney John De Leon told the board the withdrawal arrived within 30 days after the prior adjournment and therefore, by statute, no reconvening of the hearing was required. “The resolution does identify that the written notice and request to withdraw…was received within 30 days,” De Leon said.
Commissioner Toman questioned whether the board needed to reconvene to act on the resolution; the chair and county attorney both said it was unnecessary. Commissioner Richards moved to approve the resolution and Commissioner Jones seconded. The motion carried unanimously.
The chair noted staff and commissioners had prepared extensive background materials for the earlier hearing and thanked staff for their work in reviewing legal and parcel facts related to the petition. The denial ends the current formation effort; the chair said the county had discussed potential future coordination with Lincoln County if stakeholders request enhancements later.
