The Board approved Marshall County Zoning Variance No. 2026-VAR-6035 to permit creation of a new parcel for Joann and Stephen Daters despite a preexisting shed located about 4 feet from the property line where county setback rules require 15 feet. The variance allows the parcel transfer but explicitly does not permit expansion or additional construction of the nonconforming shed.
Dan Matzinger, a professional land surveyor with Clappsaddle-Garber and Associates, explained the site conditions to the Board. The motion to approve the variance was carried 3-0.
