Box Elder Commission approves smaller agricultural protection area after public hearing
Summary
After a public hearing, the Commission approved Resolution #26-22 creating an agricultural protection area limited to one parcel of about 12.01 acres; a public commenter argued the designation infringed property rights.
At a public hearing on July 7, County Clerk Marla Young told the Commission the original application for an agricultural protection area included five parcels but four were in unzoned areas and therefore excluded. The resolution that the Commission approved includes one parcel of approximately 12.01 acres. The Planning Commission and advisory boards were consulted and the Commission considered the statutory criteria required under Utah Code Title 17, Chapter 81.
Public commenter DeAnna Hardy urged the Commission to protect private property rights, saying the government was "usurping power that they do not have" and urging commissioners to adhere to constitutional protections. The Commission voted on Resolution #26-22 by roll call; Chairman Tyler Vincent, Commissioner Boyd Bingham and Commissioner Lee Perry each voted "Yea" and the motion carried unanimously, establishing the modified agricultural protection area with the Clerk instructed to file and transmit the resolution as required by statute.
