Carl Brown described a licensing review for a recycler/"automobile graveyard" at 940 Washington Ave and asked the council for guidance on correcting inconsistencies between the city form, the local ordinance and state licensing requirements.
Brown warned that the license text currently refers to retail auto sales and charges the planning director with enforcement duties that, under state law, belong to an appointed code enforcement officer. "by state law, only a a code enforcement officer, a named code enforcement officer that you all appoint can do any enforcement when it comes to, the your codes and ordinances," Brown said, urging corrections so the license language reflects who has enforcement authority.
Staff told council the site is a legal nonconforming use under zoning but that operational and environmental standards (MS4, floodplain, state stormwater requirements) still apply. Brown said options include drafting corrected license conditions, pursuing ordinance changes where necessary, or using a consent-decree-style agreement to allow operations to continue while clarifying responsibilities. The city manager said staff has been working with the property owner and will bring recommendations and legal analysis back to council ahead of the license renewal.
