Residents press Olathe to enforce stormwater code after repeated flooding

At the end of the Sept. 16 council meeting several residents raised complaints about neighborhood flooding and the city's responsibility to enforce stormwater performance and maintenance requirements.

Resident Kate Gimbelo told council she reviewed municipal code 17.04.070 and concluded developers are required to post performance and maintenance bonds guaranteeing stormwater systems are constructed correctly and that the city engineer can order remedial work if the responsible party fails to act. “The city has both the power and the duty to act,” Gimbelo said, asking the council to explain why the city had declined to hold developers responsible in specific neighborhood failures and citing a city‑approved $4.8 million replacement for another stormwater system as precedent.

Council members asked staff to follow up and requested the resident send the cited code and documentation; staff acknowledged the concern and said they would provide additional records. The exchange focused on code interpretation and the mechanics of bond release, city remedies and timelines for remedial action.

The council did not take formal action on the record that night but staff were asked to review the cited municipal code section, the status of any bonds or warranties and options for remedial enforcement under the code.
