The Administrative Appeals Board on July 15 upheld the city’s administrative decision to fine the owner of 379 West Avenida $2,500 and to suspend the property’s vacation‑rental registration certificate for six months.
City staff said the property — permitted for up to 26 contracts annually as a new permittee — lacked contract summaries for many stays documented on Airbnb and VRBO. ‘‘During the course of an operational audit... staff found the property in violation of PSMC 5.250.070(h,’’ code compliance supervisor Mitch Napan told the board, and Officer Dustin Wade testified that platform reviews and listing records produced what staff calculated as 64 evidence days of stays during the audited period.
Appellant Kareem Cervantes, joining by Zoom, said he was a first‑time homeowner who hired a management company, cooperated with requests for records, and relied on the agent’s representations. ‘‘I fully understand that as the property owner, I am ultimately responsible for my short term rental,’’ Cervantes said, adding that he had taken steps to replace the manager and to comply going forward. Board members expressed sympathy but noted the municipal code holds owners strictly liable; a motion to uphold the citation carried on roll call, 5-0.
